Court Decisions, Permits, Board Decisions
There have been a slew of court cases in the last three years, some of which are ongoing, but all of which will continue to define the ways in which people may develop their properties in our area. These cases may involve individuals, but the implications and results of them are affecting all of us, be our holdings large or small, recent or old. Some of the decisions passed down by the courts have been cited by people who are now obtaining permits to build on substandard size lots, in areas which I certainly had previously thought were somewhat protected from certain types of activities, but which are being built out in areas where no-one would have thought to even attempt to construct houses ten years ago. Because there has been so much confusion about the issues involved, the legal ramifications of these lawsuits, the players their actions to get permitted and their motivations in doing so, I have decided to put this site together as a means to get some of the publicly available information out to the community at large. Many people may have heard of some of the decisions being made in court but either not known where to find the information or been unable because of distance to be able to get access to it. I hope this may be useful to us all now in what has become to some of us a very divisive time in the community.
What was once a sanctuary has for some of us, has become a battle ground, and every movement of people in the area has become suspect as roads are put in, paths are cut through areas where no-body ever needed to go, and fences are erected in an attempt to define territories and assert rights which many may of us had no idea existed or were a problem for anybody. Courtesies extended to people have been met with vicious reprisals through legal activities which have no basis for the truth. The lengths to which people have been willing to pursue the definition of these "rights", without any regard for common courtesies to neighbors underscores their importance to development schemes which are occurring, literally, in some of our back yards. It is certainly taking place in mine, permits have been issued by the State and the town for projects ON OTHER PEOPLE"S LAND with no notification to the actual landowners, and the manner in which all this is being done is worthy of very close scrutiny. Of great importance to us all is the manner in which the permitting for these projects is being achieved, what role you may have in affecting that permitting and how what is being done now will affect other properties in the area as these precedents are set, not always in ways which you might think they are being handled by the State and by the Local government .I have spent a huge amount of time trying to fathom how and why permits have been issued and can only conclude that policies are being shaped which, if not affected by the community at large will result in wide ranging destruction of our much loved landscapes, even our back yards as is happening to me.
