Water levels
engulfed Chester leach field (located behind black fence in middle of
picture) during October of 2005, then had frozen in Jan 2006. This site
has been known to fill with the waters of Silver Lake for decades. (no

The boundary of my propertry
lies under water which surrounds House site and covers leach field (left).
These waters directly connect to Silver Lake and a large portion of my
land. Note the state of the "erosion fencing" in upper right
hand corner of photo. This is required by DEP but has never been installed
correctly or effectively. It is supposed to prevent fill introduction
into wetlands and any other water bodies present. This water connects
to Silver lake and is part of my drinking water supply. It is being polluted
by the fill having been introduced in what was a pristene dune habitat.

| DEP permitted driveway which covers, crosses, and dams wetlands, is almost covered with water in October 2005, having eroded heavily with two months long inundations of water from Silver Lake. These same waters back up onto my land, and they cover the Phippsburg sewage permit leach field in the picture above. To build a viable driveway and leach field, more fill will have to be introduced. A culvert allowing the flow of water through the driveway under the driveway was required by DEP but never installed by the developer. Erosion fencing was never properly installed to prevent leaching of sediments onto my property, also required by state laws. Repeated attempts to get DEP to enforce their own state federally required laws have been fruitless. the town of Phippsburg has allowed the installation of septics in pond zones which cross property boundaries, causing the potential for catastophic damage to my land. and surrounding building site January 2006, covered since October 2005
and still covered as of march 2006. water was present here from March
2005 (just after the foundation was installed) through mid July 2005.
